Dr. Babiak Cleared of Charges Brought by 'Eager' Prosecutor

Dr. Eugenia Babiak, the Toms River, NJ, physician was cleared of all charges by a Middlesex County jury which took only 90 minutes before acquitting her of the rare charge of failing to properly care for her father.

The jury heard testimony that Eugene Babiak, 93, was not given proper care by his daughter but rejected the Middlesex County prosecution's charges.

Later, Dr. Babiak said, "I took care of my father to the best of my ability, and I did everything I could for him. I didn't do anything wrong, and then to go through all this..."

She described the two week trial as a terrible ordeal.

But the question remains: Why was she brought up on charges that were mind boggling to everyone?

Rarely is such a case brought before the court.

Dr. Babiak displayed pictures of her father smiling and looking well.

She even brought her father to work in her medical office so she could keep an eye on him because he refused go to a hospital and was fear of living in a nursing home.

Dr. Babiak's father died in 2004 in a hospital.
